Terms and Conditions of Your Booking

Last updated: September 8, 2026.

By confirming your booking, you accept these terms. Please read them: they state exactly what you are buying, from whom, and what happens if something changes.

1. Who you are contracting with

The activity is provided and operated by the business that appears as the provider on your booking (the "Operator"): it is the owner of the vessel, the party that provides the captain and crew, and the party responsible for ensuring that the trip takes place.

BlueNavyCabo is the technology platform where the Operator publishes its availability and where you book and pay. BlueNavyCabo does not provide the nautical service or operate the vessel.

Your payment receipt, your ticket and your emails always bear the Operator's name.

2. Your booking

  • Your spot is reserved once your payment is credited. Until then, there is no booking.
  • The price you see when booking is the final price in Mexican pesos, including VAT (IVA). No charges are added afterward.
  • The information you provide (name, email address, telephone number and, if applicable, that of your companions) is used to issue your ticket, contact you about your trip and comply with the requirements of the maritime authority.
  • Make sure your email address is spelled correctly: that is where you will receive your ticket.

3. The day of your trip

  • Arrive at the place and time indicated on your ticket. A trip does not wait for latecomers, and arriving late may be treated as a no-show.
  • Follow the instructions of the captain and crew at all times: they are mandatory for safety reasons.
  • The Operator may deny boarding to anyone who arrives in an unfit condition, refuses to use the safety equipment or endangers others. In that case, there is no refund.
  • If you have a medical condition, are pregnant, cannot swim or are traveling with minors, notify the Operator before the trip.

4. Weather and safety

The Operator may cancel or reschedule a trip due to weather, sea conditions, mechanical failure or instructions from the authorities. These decisions are made for safety reasons.

If this happens, the Operator will offer to reschedule your trip or refund your money. That decision and that process are handled directly with the Operator.

5. Changes and cancellations

The cancellation and change policy is set by each Operator, and it is the policy you were informed of when booking or the one shown on the page where you booked. If you have any questions about it, ask the Operator before paying.

Refunds are made to the same payment method you used. When they are processed through the Platform, the money is returned to your card; your bank may take a few business days to reflect it.

6. Your personal data

The Operator is the Data Controller of your personal data and processes it in accordance with its own privacy notice. BlueNavyCabo processes it on behalf of the Operator (as Data Processor), solely to operate the booking, the payment and the notices about your trip.

You may exercise your rights of access, rectification, cancellation and opposition (ARCO rights) with the Operator. You may also write to the Platform at santiagotangassi@gmail.com and your request will be forwarded accordingly.

The Platform's privacy notice is available at https://bluenavycabo.com/privacy (binding Spanish version: https://bluenavycabo.com/privacidad).

7. Liability

Nautical and water activities involve risks that no measure can completely eliminate. By booking, you acknowledge that you are participating voluntarily and that you will follow the safety instructions.

Any claim relating to the provision of the service (what happened on board, the condition of the vessel, the treatment received or compliance with the itinerary) must be directed to the Operator, which is the party that provides the service. BlueNavyCabo is responsible for the operation of the Platform: that your booking is recorded, that your payment is processed correctly and that your data is processed as described in this document.

Nothing in the foregoing limits the rights that Mexican law grants you as a consumer.

8. Issues with your booking

Talk to the Operator first: it is the party that can resolve the issue. Its contact details are on your ticket and in your emails.

If the problem lies with the Platform (you did not receive your ticket, a duplicate charge or a system error), write to santiagotangassi@gmail.com.

As a consumer in Mexico, you may turn to the Procuraduría Federal del Consumidor (PROFECO) (Federal Consumer Protection Agency).

9. Governing law

These terms are governed by the laws of the United Mexican States.

When you confirm your booking, a record is kept of the exact version of this document that was shown to you, with the date and time. This record serves as evidence for both parties.
